Terms of Service
The legally binding agreement between you and Cartlyf Technologies Limited.
1. The Platform Role
FLYTS is a technology marketplace platform that connects car owners ("Hosts") with individuals looking to rent vehicles ("Renters").
FLYTS offers two primary rental modes: Self-Drive (where the Renter drives the vehicle) and With Driver / Chauffeur Service (where the Host or a vetted third party provides driving services).
Important: Cartlyf Technologies Limited is NOT a car rental company or a chauffeur service provider. We do not own, operate, or insure the vehicles, nor do we employ the drivers. All rental and service agreements are formed directly between the Host and the Renter.
2. Eligibility and Verification (KYC)
To use FLYTS, you must:
- Be at least 18 years of age.
- Hold a valid Kenyan Driver's Licence (or international equivalent with appropriate permits).
- Successfully complete our Know Your Customer (KYC) verification, which includes a selfie-match against your ID.
- Provide accurate, current, and complete information during the registration process.
3. Booking, Escrow & No-Deposit Policy
To provide a frictionless and secure marketplace, FLYTS utilizes a proprietary verification-based model:
- No Security Deposit: Unlike traditional car rentals, FLYTS verified users are NOT required to pay a security deposit. Your account is secured by your KYC (ID + Selfie match) and your linked payment method.
- Payment: When a Renter books a car, the full amount (Rental Fee + Insurance + Service Fee) is charged via the App.
- Escrow: The funds are held securely by Cartlyf and are not immediately released to the Host.
- Payout: Funds are released to the Host's wallet 24 hours after the scheduled start of the trip, provided no dispute has been raised.
4. Condition Records (Mandatory Photos)
To protect both parties, the Platform requires "Condition Records" for every trip:
- Pre-Trip: Renters and Hosts must take and upload high-quality photos of the vehicle (all 4 sides, interior, fuel gauge, and odometer) before the keys are handed over.
- Post-Trip: The same set of photos must be uploaded upon return.
- Waiver: Failure to provide these photos via the App may result in the automatic denial of any damage or fuel mismatch claims.
5. Prohibited Uses
You agree NOT to use any vehicle rented through FLYTS for:
- Off-road driving (unless the vehicle is explicitly listed as a 4x4 and approved for such use).
- Commercial sub-leasing or ride-hailing (Uber/Bolt) unless specifically authorized in writing.
- Racing, pace-making, or speed testing.
- Towing or pushing another vehicle without Host consent.
- Transportation of hazardous or prohibited materials under Kenyan law.
6. Standard Fees and Fines
The following industry-standard fees apply to protect our community:

7. Insurance and Liability
- Host Insurance: Hosts must maintain active Comprehensive Insurance as required by the laws of Kenya.
- Renter Liability: In the event of an accident where the Renter is at fault, the Renter is responsible for the "Insurance Excess" (Deductible) and any loss of use daily rates not covered by insurance.
- Platform Immunity: Cartlyf is not liable for any mechanical failures, traffic violations, or criminal acts committed by users.
8. Cancellations and Refunds
Our tiered cancellation policy protects Hosts' schedules and ensures platform stability:
- Full Refund (100%): Cancellations made more than 48 hours before the trip start time.
- Partial Refund (85%): Cancellations made between 24 and 48 hours before the trip start time.
- Standard Refund (70%): Cancellations made less than 24 hours before the trip start time.
- Same-Day Policy: For bookings made and cancelled within 30 minutes, a full refund applies. After 30 minutes, same-day cancellations are non-refundable.
9. Chauffeur Mode (With Driver) Specifics
When a trip is booked in "With Driver" mode, the following additional rules apply:
- Driver Provision: The Host is responsible for providing a driver who holds a valid PSV (Public Service Vehicle) licence where required by Kenyan law and has passed FLYTS's basic vetting.
- Liability Shift: Unlike Self-Drive mode, in Chauffeur mode, the Host/Driver is solely responsible for traffic violations, accidents, and collision damage to the vehicle during the trip.
- Renter Responsibility: The Renter remains liable for any damage to the vehicle's interior caused by passengers and for ensuring the safety of their personal belongings.
- Operating Hours: Standard chauffeur services are for 8 hours per day within town limits. Extra hours or "out-of-town" trips must be agreed upon and may incur additional charges through the Platform.
10. Dispute Resolution (ADR)
Any dispute arising between a Host and Renter, or between a User and Cartlyf, shall first be subjected to mandatory mediation facilitated by Cartlyf's Trust & Safety team.
If mediation fails, disputes shall be settled by the competent courts of the Republic of Kenya, with Nairobi designated as the primary legal venue.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Kenya, including the Consumer Protection Act (2012).
